DEVELOPING INDUSTRIAL SAFETY DECLARATION

According to Article 76 of the Law of the Republic of Kazakhstan “On civil protection” of 11.04.2014 N 188-IV:

  1. Dangerous industrial facilities which comply to criteria of classification of dangerous industrial facilities approved by the Government of the Republic of Kazakhstan should be subject to mandatory declaration of industrial safety.
  2. The declaration of industrial safety for a dangerous industrial facility (hereon referred to as declaration) is developed for projected and existing dangerous industrial facilities.
  3. The declaration should be developed by the company which operates such dangerous industrial facility on its own if the company has a certificate that grants right to develop such declarations, or by a third-party company which has a certificate that grants right to develop such declarations.
  4. The declaration is approved by the head of the company which operates a dangerous industrial facility.

The head of the company which operates a dangerous industrial facility is responsible for promptness, fullness and authenticity of data in the declaration as set by the laws of the Republic of Kazakhstan.

  1. The declaration should be subject to expert review in the company which has a certificate that grants right to develop such declarations.
  2. To assign a registration number to the declaration, the applicant submits to the authorized body in industrial safety an electronic application, an electronic declaration, and a scanned copy of expert opinion.

The authorized body in industrial safety after a review of submitted documents renders a decision to register a declaration or delivers a substantiated refusal.

The declaration following registration in the authorized body in industrial safety is stored in the authorized body in industrial safety in the form of electronic document.

  1. The exploitation of dangerous industrial facility without the declaration registered by the authorized body in industrial safety is prohibited.
  2. The list of registered declarations is published on internet resource of the authorized body in industrial safety.
  3. If conditions which impact supporting industrial safety change, including upgrade or conversion of dangerous industrial facility, the declaration is subject to amendments.

Once declaration is amended, it should be reviewed and registered again within three months following such amendments.
